The Site Owner is also known as Booking Rooster Ltd, or CC Training Academy “Booking Services” means the services enabled by the functionality of the site which includes, but is not limited to the ability to create an organisation, create , list, promote and manage an event, add a banner advertisement or link, book tickets, make, receive or account for payments, or post to social media or calenders. “Buyer” means any person or organisation who books a ticket using this Site, including people or organisation’s booking free tickets. “Seller” means any person or organisation who sells tickets on this Site, including those tickets which are offered free of charge and anyone posting a “listing” on the Site. “Advertiser” means any person or organisation who posts an advertisement on the site. Where the advertisement is added to the site by a “Seller” the Seller is deemed to have the responsibilities of the “Advertiser” even if they do not own or benefit from the advertising content. “Site User” means anyone who uses the services available on the site, including buyers, sellers, advertisers and those who browse the site. “Event” means any course, event, or other product or service listed using the organiser’s “Event” module in this Site. This is also known as a “Listing” “Listing” means the same as “Event” “Connect” means to complete the sign-up process using any ‘sign-up’ button on the Site. “Community” means people or organisations who have signed up to use CC Training Academy, to list or book events. Specific WarningsThe Services: This Site provides a venue to enable organisations from within the CC Training Academy community to list events and process bookings. The Site Owner does not take any part in the sale of tickets other than by providing our Website as a venue for Buyers and Sellers. If a booking is made on this site, a contract of sale will be formed between the Buyer and the Seller directly. We do not act as agent for either party and do not participate in any sale or transaction between Site Users. When you make a booking using this site you are buying direct from the Seller and not from the Site Owner. The Site Owner has no responsibility for the listings, advertisements or other site content, At your own risk: Transactions and all other contact between you and other Site Users are conducted entirely at your own risk. You agree that the Site Owner takes no responsibility or liability for any misconduct of any Site User including, without limitation, Site Users that have registered under false pretences or who attempt to defraud you. Terms of SaleIf you buy or sell a ticket on the System you agree to the general terms and conditions of sale, and to any specific terms and conditions drawn to your attention when you book that ticket. PoliciesThe Site Owner has strict policies to protect its users. If you use the Site to book tickets or to assist in any way with listing and/or accepting bookings for an event, you are agreeing to comply with these policies. TerminationThe Site Owner may, at its sole discretion, terminate this agreement or restrict your access to the Site without advance notice or liability, for any reason, including your failure to comply with the terms of use of the Site. If your account is terminated you must stop using the Site. Without limiting any other rights and remedies available to the Site Owner, the Site Owner may limit your activities on the Website, remove your organisation, listings, advertisements, bookings or other content, warn members of the community about your actions, issue a warning to you, suspend or terminate your use of the Site, or refuse to provide our Services to you if you breach these terms and conditions. In the event of termination for non-compliance with these terms, all rights granted to you will terminate and you will still be liable for any fees and charges that you have committed to during your use of the Site, including but not limited to subscription fees, advertising and ticket purchase prices. AvailabilityThe Site Owner uses reasonable commercial efforts to keep the Site available 24/7. Exceptions are scheduled maintenance, unscheduled maintenance and system outages. ContentThe information in event listings is provided in good faith. Sellers and Advertisers using this Site undertake to take all reasonable care to keep the information on the site accurate. The Site Owner assumes no liability or responsibility for any errors or omissions. Buyers are responsible for evaluating the accuracy, completeness and usefulness of all content available through the Site or from a linked Site. Buyers should not assume any booking on this Site is complete until a confirmation email is received from the event organiser, you have made the required payment and you have complied fully with the terms of sale and any other requirements displayed in the event listing. Security Capabilities and Policy for Transmission of Payment Card DetailsWhen you pay by credit card via this site you are passed to an e-commerce gateway provider. You will see the provider name before you enter your credit card details. The provider may be ANZ e-Gate, DPS Payment Express, Paymark, Stripe, Braintree, eWay or PayPal. You will enter your credit card details within the secure environment provided by the e-commerce gateway provider. When the provider makes these available, we may store your cardholder name and a masked version of your card number. At no time do we store or have access to your complete card number or other card details. All providers are compliant with the Payment Card Industry Data Security Standard (PCI DSS). All communication between this site and the payment gateway is encrypted by 128 bit Secure Sockets Layer (SSL) technology. Credit Card TransactionsIf you are the cardholder and you dispute any charge on your credit or debit card related to any event booked through this Site you agree to notify the Seller within 24 hours of the scheduled event start time. PoliciesThe Site Owner’s Privacy PolicyThe Site Owner values privacy and understands that you value yours. If you use the Site to list events, book tickets, sell tickets or advertise you are bound by this privacy policy. Your “My Profile” and "My Event" pagesIf you connect to any organisation using the ‘sign-up’ process a “My Events” page will automatically be created for you. Your "My Events" page is private. Your personal details can only be accessed by the Site Owner and the ticket Sellers you connect with, and you. They will not be accessible to others unless you give them your Site password or click to share. Your “My Events” history can only be accessed by the Site Owner and you. Sellers can also see which of their own events you booked for and any details you entered at the time of booking. They cannot see what bookings you made with other organisations. Who do we share your personal information with?The Site Owner and the Seller will not share the information that we collect with any third parties, except as required to administer the specific event you have registered for. You can choose which details you share at the time you register, and if you create a Site password you can amend them at any time on your "My Profile" page. Everyone the Seller contracts or collaborates with in running events agrees to keep that information private, but the Site Owner cannot guarantee the Seller or their contacts will comply. The information may be hosted with a service provider. Our agreements with them protect the information that we collect from any use by them that we have not authorised. How do we use the information?The Site Owner may from time to time offer service bulletins, special deals and other promotions. We may also use the data to check your identity if you need help with a forgotten password, or you are having difficulties with any of our Site services. From time to time we may aggregate data analyse trends, preferences, and demographics. We may use the aggregated information for other purposes with your prior permission. Event cancellation policyIf an event is cancelled after the tickets are bought and paid for, or the event is not of the standard the ticket buyer could have reasonably expected, the ticket buyer may be entitled to be refunded for their ticket purchase under the Consumer Guarantees Act 1993. The ticket seller reserves the right to cancel without refund in a force majeure event. If you believe the event has been cancelled or is not of the standard that could have been reasonably expected, please contact the Seller, on or . If a dispute arises between the Buyer and Seller that you are unable to resolve please remember that the dispute is directly between the Buyer and Seller. If you wish to inform the Site Owner please do so here so we can consider whether your experience raises issues that we need to act on for the protection of other Site Users. Advertising policyDepending on specific arrangements between the Site Owner and the Sellers using the site, it is possible for either of these parties to place advertising banners beside listings. Sellers who place advertisements on the site are responsible for ensuring that Advertisers know that that all advertisements must be:
Ticket buyer’s complaint policyIf you buy a ticket and you feel you might have a legal right to receive a refund from the ticket Seller you must make a complaint directly to the Seller, , by clicking the urgent help link within 24 hours of the event's scheduled start time. At the end of that 24 hour period the Seller will not guarantee to be able to help you with refunds in any way. The Seller will be deemed to have fully discharged all legal responsibility it might ever have had, toward the ticket buyer in respect of that event. All complaints must be made by clicking the "bone to pick" link from your "My Connections" page or by email to . If your complaint is made through the ‘bone to pick’ link the Seller will return an acknowledgement of the complaint within fifteen minutes of its receipt. Acknowledgement of email links may take longer and are likely to be made during business hours only. If that acknowledgement is not received, please re-submit the complaint and call on Complaints are only considered by once they have been acknowledged. and the Site Owner can’t be held responsible for failure in email, internet, fax, telephone, courier, postal service, telegraph and the likes.
