  • When you book or sign up on this site you are sharing your details direct with the organisation whose booking page you are on. Be sure you only book with organisations you trust to keep your information private.
  • You can cancel your connection to any organisation, at any time following the opt-out link.

Your Promises:

  • You must be 18 years or older to book tickets using this Site.
  • If you use this Site for any purpose you agree to the terms of use of the Site.
  • If you buy or sell tickets on this Site you also agree to the terms of sale.
  • You accept that you are buying direct from the organisation listing the event, not from CC Training Academy or its owner Booking Rooster Ltd
  • You acknowledge that use of this Site is at your own risk and you will not hold CC Training Academy or its owner responsible for the content on the site, or anything that happens as a consequence of you visiting it.
  • If you sell tickets on this Site:
    • You also agree to the terms of sale
    • You agree to keep any information Site Users share with you private.
    • You agree to meet all your legal obligations to the Buyer.

Terms and conditions of using this site

Welcome to the CC Training Academy online booking site. This is an online booking service provided by Booking Rooster Ltd, also known as the "Site Owner" or CC Training Academy. It is accessed through the website book.ccta.co.nz, also known as "the Site" and "the System".

Please read these terms and conditions carefully. By using the Site you are a "Site User" and agree to these terms of use. Site Users include people who list events, place advertisements, book event tickets, view the Site or use it in any way. If you choose not to be bound by the terms and conditions, you must not use this Site.

Acceptance of terms and conditions: The terms and conditions are terms on which CC Training Academy offers you access to the Booking Services and the Website. You accept these terms and conditions by:

  • creating an organisation on this site
  • listing an event on this site,
  • placing an advertisement on this site
  • making a booking on this site or
  • signing up to any organisation on this site.

If you do not accept these terms and conditions, you must refrain from using the Booking Services on this site.

Amendment of terms and conditions: As CC Training Academy operates in a changing commercial, technological and regulatory environment, we may amend these terms and conditions from time to time. We will communicate all changes in our News Feed. Occasionally, we may make urgent changes, but will generally give you at least two weeks’ notice to review these changes. We may also seek your feedback on proposed changes on our News Feed, or, for significant changes notify you directly via email. Unless otherwise stated, amendments will be effective immediately upon posting of the amended terms and conditions on this Website. You are responsible for ensuring you are familiar with the latest terms and conditions. Your continued use of the Booking Services represents your agreement to be bound by the terms and conditions as amended. These terms and conditions were last updated 15 July 2016.

Terminology:

In these terms and conditions, the following expressions have the meanings set out:

“Site” means the website book.ccta.co.nz.

“Site Owner”, means the owner of the website address this booking system is delivered on. The Site Owner is also known as Booking Rooster Ltd, or CC Training Academy

“Booking Services” means the services enabled by the functionality of the site which includes, but is not limited to the ability to create an organisation, create , list, promote and manage an event, add a banner advertisement or link, book tickets, make, receive or account for payments, or post to social media or calenders.

“Buyer” means any person or organisation who books a ticket using this Site, including people or organisation’s booking free tickets.

“Seller” means any person or organisation who sells tickets on this Site, including those tickets which are offered free of charge and anyone posting a “listing” on the Site.

“Advertiser” means any person or organisation who posts an advertisement on the site. Where the advertisement is added to the site by a “Seller” the Seller is deemed to have the responsibilities of the “Advertiser” even if they do not own or benefit from the advertising content.

“Site User” means anyone who uses the services available on the site, including buyers, sellers, advertisers and those who browse the site.

“Event” means any course, event, or other product or service listed using the organiser’s “Event” module in this Site. This is also known as a “Listing”

“Listing” means the same as “Event”

“Connect” means to complete the sign-up process using any ‘sign-up’ button on the Site.

“Community” means people or organisations who have signed up to use CC Training Academy, to list or book events.

Specific Warnings

The Services: This Site provides a venue to enable organisations from within the CC Training Academy community to list events and process bookings. The Site Owner does not take any part in the sale of tickets other than by providing our Website as a venue for Buyers and Sellers. If a booking is made on this site, a contract of sale will be formed between the Buyer and the Seller directly. We do not act as agent for either party and do not participate in any sale or transaction between Site Users. When you make a booking using this site you are buying direct from the Seller and not from the Site Owner. The Site Owner has no responsibility for the listings, advertisements or other site content,

At your own risk: Transactions and all other contact between you and other Site Users are conducted entirely at your own risk. You agree that the Site Owner takes no responsibility or liability for any misconduct of any Site User including, without limitation, Site Users that have registered under false pretences or who attempt to defraud you. The Site Owner gives no undertakings, representations, or warranties in relation to listings or advertisements on this Site, including but not limited to:

  • as to the content, safety, description, worthiness, quality, or legality of events listed on the Website;
  • as to the accuracy or truth of listings;
  • as to whether the event listed, will meet your requirements or expectations; or
  • about the ability of the Seller to deliver the event,
  • about the ability of Site Users to complete a transaction, including credit card transactions and refunds.

Disclaimer: You expressly understand and agree that:

  • your use of the Booking Services is at your sole risk. The Website and Booking Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, the Site Owner disclaims and excludes all implied conditions or warranties, including, but not limited to, any warranties of merchantability, fitness for a particular purpose, and non-infringement;
  • the Site Owner disclaims and excludes liability for any guarantees that an event will be delivered with reasonable care and skill, fitness for a particular purpose, time of completion or price for the event;
  • the Site Owner does not warrant that the Services provided will be uninterrupted, timely, secure, or error free, or that any information provided on the Website is error-free or reliable;
  • no advice or information that is obtained by you from the Site Owner or anyone else shall create any warranty by the Site Owner that is not expressly stated in the terms and conditions; and
  • responsibility for the content of listings appearing on this Website (including hyperlinks to seller's own websites) rests solely with the Seller. The placement of such listings on the Website does not constitute the Site Owner’s recommendation or endorsement of the advertised product or service. Each Seller is solely responsible for any representation made in connection with its listing.
  • responsibility for the content of advertisements appearing on this Website (including hyperlinks to advertisers' own websites) rests solely with the Advertiser. The placement of such advertisements on the Website does not constitute recommendation or endorsement of the advertised product or service by the Site Owner or Seller. Each advertiser is solely responsible for any representation made in connection with its advertisement.
  • while the Site Owner may facilitate payment for some items by credit card, it is in no way involved in the transaction itself, and responsibility for any refund rests with the seller.
  • while the Site Owner has systems in place to reduce the risk of credit card fraud, the Site Owner is not responsible for protecting members from credit card fraud. The Site Owner's fraud protection systems may from time to time block legitimate credit card payments. In these cases payment will need to be made by other means.

Terms of Sale

If you buy or sell a ticket on the System you agree to the general terms and conditions of sale, and to any specific terms and conditions drawn to your attention when you book that ticket.

Policies

The Site Owner has strict policies to protect its users. If you use the Site to book tickets or to assist in any way with listing and/or accepting bookings for an event, you are agreeing to comply with these policies. Please read the policies carefully before you use this Site:

Termination

The Site Owner may, at its sole discretion, terminate this agreement or restrict your access to the Site without advance notice or liability, for any reason, including your failure to comply with the terms of use of the Site. If your account is terminated you must stop using the Site. Without limiting any other rights and remedies available to the Site Owner, the Site Owner may limit your activities on the Website, remove your organisation, listings, advertisements, bookings or other content, warn members of the community about your actions, issue a warning to you, suspend or terminate your use of the Site, or refuse to provide our Services to you if you breach these terms and conditions. In the event of termination for non-compliance with these terms, all rights granted to you will terminate and you will still be liable for any fees and charges that you have committed to during your use of the Site, including but not limited to subscription fees, advertising and ticket purchase prices.

Additional rules: In addition to the terms and conditions set out in this document, the policies form part of these terms and conditions.

Availability

The Site Owner uses reasonable commercial efforts to keep the Site available 24/7. Exceptions are scheduled maintenance, unscheduled maintenance and system outages. We cannot promise that the Site will always be available and assume no liability or responsibility for any interruption or its consequences. Book early to avoid disappointment.

Content

The information in event listings is provided in good faith. Sellers and Advertisers using this Site undertake to take all reasonable care to keep the information on the site accurate. The Site Owner assumes no liability or responsibility for any errors or omissions. Buyers are responsible for evaluating the accuracy, completeness and usefulness of all content available through the Site or from a linked Site. Buyers should not assume any booking on this Site is complete until a confirmation email is received from the event organiser, you have made the required payment and you have complied fully with the terms of sale and any other requirements displayed in the event listing.

Security Capabilities and Policy for Transmission of Payment Card Details

When you pay by credit card via this site you are passed to an e-commerce gateway provider. You will see the provider name before you enter your credit card details. The provider may be ANZ e-Gate, DPS Payment Express, Paymark, Stripe, Braintree, eWay or PayPal. You will enter your credit card details within the secure environment provided by the e-commerce gateway provider. When the provider makes these available, we may store your cardholder name and a masked version of your card number. At no time do we store or have access to your complete card number or other card details. All providers are compliant with the Payment Card Industry Data Security Standard (PCI DSS). All communication between this site and the payment gateway is encrypted by 128 bit Secure Sockets Layer (SSL) technology.

Credit Card Transactions

If you are the cardholder and you dispute any charge on your credit or debit card related to any event booked through this Site you agree to notify the Seller within 24 hours of the scheduled event start time. You agree that Seller will have authority fully equal to that of their suppliers in collecting amounts owed for bookings made through this Site from your bank/credit card company or through courts/collection agencies.

Intellectual Property

The information contained within this Site, including graphics and logos controlled by the Site Owner, are the copyright of the Site Owner. All other information contained within this Site, including graphics and logos, are the copyright of the Seller who uploaded them. All programming scripts are copyright of Booking Rooster Ltd who developed the Site. All trademarks on this Site are trademarks of their respective owner. Nothing contained on this Site should be construed as granting any license or right of use of any trademark or copyright displayed on the Site without the express written consent of the Site Owner or the third party owner of Intellectual Property.

Links

The Site Owner and Sellers provide links to other sites. When you click on these links you are leaving our Site and entering another site. These linked sites are not under the control of the Site Owner or the Seller, and the Site Owner is not responsible for the contents of any linked site. Doing so is entirely at your own risk. You should read the terms and conditions of these sites before using these sites. You may create links from your own website to this Site through a plain text link or through the Site Owner's branded link, provided that you:

  • discontinue the link if requested by the Site Owner or the Seller whose listing you have linked to,
  • do not imply in any way that the Site Owner or any Seller listed on this site is endorsing your products, services, organisation or anything affiliated with you,
  • represent The Site Owner fairly and accurately,
  • acknowledge all copyright and only use a plain text link or the branded link provided.
  • The Site Owner reserves the right to require you to remove links to the Site at its sole discretion.

Exclusion of warranty

The Site Owner makes no warranty of any kind regarding this Site and/or any materials provided on this Site, all of which are on an "as is" and "as available" basis. The Site Owner does not warrant the accuracy, completeness, currency or reliability of any of the content of the data found on this Site and expressly disclaim all warranties and conditions of any kind.

Limitation of Liability

The Site Owner will not be held liable for the following, or their consequences:

  • any technical difficulties, malfunction, failure or delay (including, but not limited to the use of or inability to use any component of this Site for bookings or ticketing),
  • the performance or non-performance by the Site Owner, Sellers, Advertisers, Buyers or any third party providers or distributors, even if such party has been advised of the possibility of damages to such parties or any other party; and/or
  • failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record.
  • The Site Owner may at its sole discretion terminate or restrict your access to any component of this Site, at any time without liability.

You agree that, to the maximum extent permitted by law, any and all liability and responsibility of the Site Owner to you or any other person under or in connection with these terms and conditions, or in connection with the services, this Website, another Site User’s acts or omissions, or your use of or inability to use, the services or this Website, is excluded regardless of whether such liability arises in contract, tort (including negligence), equity, breach of statutory duty or otherwise. The Site Owner's liability and responsibility is excluded in respect of any and all loss or damage, whether direct or indirect, including, without limitation, loss of profits, loss of data, loss of business or anticipated savings, general and special damages, and consequential and incidental loss.

Indemnity

You shall defend and indemnify the Site Owner and any third party providers and distributors and their officers, directors, employees and agents from and against any claim, cause of action or demand, including without limitation reasonable legal and accounting fees, brought by or on your behalf in excess of the liability described herein in any action filed or commenced by any third party against the Site Owner as a result of

  • your breach of these Terms or the policies made part of these terms by reference,
  • your violation of any law or the rights of a third party
  • your use of our Site.

You agree to release, indemnify and keep indemnified us from and against all actions, claims, costs (including legal costs and expenses), losses, proceedings, damages, liabilities, or demands suffered or incurred by us to any person arising out of or in connection with your failure to comply with these terms and conditions, your failure to complete a transaction, your use of the Site, or arising out of any content or event you submit, post, transmit, or make available through the Services.

General

If any of our terms are held to be unenforceable, it is agreed that the remainder of the terms will remain in full force and effect. This agreement is governed by the laws of New Zealand, and you irrevocably submit to the exclusive jurisdiction of the courts of New Zealand.

Terms of Ticket Sale & Purchase

This site is an online service provided by Booking Rooster on the website book.ccta.co.nz. Unless expressly stated below, neither Booking Rooster Ltd nor CC Training Academy are parties to the sale and purchase agreement. The parties to this sale and purchase agreement are:

  • The Seller:
  • The Buyer: The Site User who books using this site.

Please read these terms and conditions carefully. By listing, buying or selling a ticket on this Site you are agreeing to these terms and conditions. If you choose not to be bound by the terms and conditions, you must not list, buy or sell a ticket on this site.

General Terms and Conditions

Tickets to this event are sold by are subject to the following terms and conditions:

  • Cancellations/Rescheduling
    Cancellation fees are based on full course costs and will be incurred on the following basis:

    • Where notice is given to CC Training 6 working days prior to scheduled training there is no cancellation or reschedule fee.
    • Where notice is given to CC Training within 3 - 5 working days prior to scheduled training there is a 50% cancellation or reschedule fee.
    • Where notice is given to CC Training 2 working days or less in advance of scheduled training, the learner does not attend the course, or the learner arrives late and is not admitted to the course there is a 100% cancellation/ reschedule fee.

    CC Training will not be liable for costs incurred by the customer due to cancellation arising from circumstances beyond our control. From time to time, we may need to reschedule a course or cancel a course due to trainer availability (sickness, bereavement etc), venue availability or low course attendance for example.

  • Certificates will be emailed within 7 working days after a course is competed and full payment is received.

  • please check the event time, date and location before your book. Tickets cannot be exchanged for other dates, times or events.
  • You must comply with any special terms and conditions specified by the Seller during the Booking Process. If you do not meet these criteria or comply with these terms and conditions you may not be admitted to the event and your ticket will not be refundable.
  • Your sale is not complete until the event takes place. If the event is cancelled for any reason the Seller is responsible for making a refund available to you, less any payment processing fee if the purchase was made via credit card.
  • Any and all details shown on your Event Registration Form will be passed to and to CC Training Academy .
  • is responsible for keeping the details you provide them confidential.
  • CC Training Academy will not provide your personal details to any other party and your credit card details will not be passed to or any third party.
  • The Site Owner's terms of use, and policies are incorporated into these terms of sale and apply to sales through this Site. Users of the Site should also read these before using this Site.

Policies

The Site Owner’s Privacy Policy

The Site Owner values privacy and understands that you value yours. If you use the Site to list events, book tickets, sell tickets or advertise you are bound by this privacy policy.

Your “My Profile” and "My Event" pages

If you connect to any organisation using the ‘sign-up’ process a “My Events” page will automatically be created for you. Your "My Events" page is private. Your personal details can only be accessed by the Site Owner and the ticket Sellers you connect with, and you. They will not be accessible to others unless you give them your Site password or click to share. Your “My Events” history can only be accessed by the Site Owner and you. Sellers can also see which of their own events you booked for and any details you entered at the time of booking. They cannot see what bookings you made with other organisations.

Who do we share your personal information with?

The Site Owner and the Seller will not share the information that we collect with any third parties, except as required to administer the specific event you have registered for. You can choose which details you share at the time you register, and if you create a Site password you can amend them at any time on your "My Profile" page. Everyone the Seller contracts or collaborates with in running events agrees to keep that information private, but the Site Owner cannot guarantee the Seller or their contacts will comply. The information may be hosted with a service provider. Our agreements with them protect the information that we collect from any use by them that we have not authorised.

How do we use the information?

The Site Owner may from time to time offer service bulletins, special deals and other promotions. We may also use the data to check your identity if you need help with a forgotten password, or you are having difficulties with any of our Site services.

From time to time we may aggregate data analyse trends, preferences, and demographics. We may use the aggregated information for other purposes with your prior permission.

How do we use "cookies"?

"Cookies" are small pieces of information stored by your browser on your computer's hard drive. Cookies do not contain personally identifying information. They do provide details of your IP address, the computer platform that you use (eg Mac or Windows), the browser that you use (eg Microsoft Explorer or Netscape) and what domain you are accessing our Site from. With this information we can do the following:

  • Ensure that the most relevant content is being shown.

Sellers Policy

Sellers using the site are responsible for ensuring that:

  • Their listings are fair and accurate.
  • The event is considered legal under New Zealand law.
  • Listings, advertisements and event content under their control is appropriate to the CC Training Academy audience.
  • Listings and advertisements under their control are consistent with the Codes of Practice of the Advertising Standards Authority
  • The event is delivered on time and to the standard that Buyers could reasonably have expected.
  • The Seller remains able to refund all Buyers, less any credit card fees, if the event is cancelled for any reason until at least 24 hours after the event.
  • The Seller responds quickly and fairly to any queries or complaints raised by Buyers.

Event cancellation policy

If an event is cancelled after the tickets are bought and paid for, or the event is not of the standard the ticket buyer could have reasonably expected, the ticket buyer may be entitled to be refunded for their ticket purchase under the Consumer Guarantees Act 1993. The ticket seller reserves the right to cancel without refund in a force majeure event.

If you believe the event has been cancelled or is not of the standard that could have been reasonably expected, please contact the Seller, on or .

If a dispute arises between the Buyer and Seller that you are unable to resolve please remember that the dispute is directly between the Buyer and Seller. If you wish to inform the Site Owner please do so here so we can consider whether your experience raises issues that we need to act on for the protection of other Site Users.

Advertising policy

Depending on specific arrangements between the Site Owner and the Sellers using the site, it is possible for either of these parties to place advertising banners beside listings. Sellers who place advertisements on the site are responsible for ensuring that Advertisers know that that all advertisements must be:

Ticket buyer’s complaint policy

If you buy a ticket and you feel you might have a legal right to receive a refund from the ticket Seller you must make a complaint directly to the Seller, , by clicking the urgent help link within 24 hours of the event's scheduled start time.

At the end of that 24 hour period the Seller will not guarantee to be able to help you with refunds in any way. The Seller will be deemed to have fully discharged all legal responsibility it might ever have had, toward the ticket buyer in respect of that event.

All complaints must be made by clicking the "bone to pick" link from your "My Connections" page or by email to . If your complaint is made through the ‘bone to pick’ link the Seller will return an acknowledgement of the complaint within fifteen minutes of its receipt. Acknowledgement of email links may take longer and are likely to be made during business hours only. If that acknowledgement is not received, please re-submit the complaint and call on

Complaints are only considered by once they have been acknowledged. and the Site Owner can’t be held responsible for failure in email, internet, fax, telephone, courier, postal service, telegraph and the likes. If you do not receive an acknowledgement email, call urgently. Do not give up calling until you have talked to someone and received your written complaint acknowledgement.

Misuse of site policy

If you have any questions about this policy, the practices of this Site, or believe another Site User has breached the terms of use of this site in any way concerns about your dealings with any other Site User, including those who have listed events on this site, you can contact us at support@bookingrooster.co.nz.

Failure to comply fully with the policies and terms and conditions of using this site is likely to result in termination of your ability to use this site.
